Interest groups representing internet companies quickly challenged the law in court, arguing that it violates the First Amendments Free Speech Clause and is preempted by Section 230 of the Communications Act of 1934. On June 30, 2021, in NetChoice v. Moody, a federal trial court granted a preliminary injunction temporarily staying enforcement of the state law, which was set to go into effect on July 1, 2021. This Legal Sidebar explains the Florida law as well as the lawsuit challenging it. The Sidebar also discusses possible implications for Congress as it considers whether to regulate online content moderation.
